TERMS AND CONDITIONS OF THE FINDTRUCKER.EU PLATFORM

1. General provisions

• Platform: The online service FindTrucker.eu, through which drivers and companies can exchange employment-related information.
• Driver: A user who registers on the platform to view job offers and contact companies.
• Company: A user who registers on the platform to post job offers and view driver profiles.
• Service provider: FindTrucker.eu, managed by Fly Eagles Fly.
• User: A user (company or driver) who uses the platform’s services.

2. Registration and user accounts

• Users must register to use the platform’s services.
• Phone number verification: Users who provide their phone number are required to verify it. The verification process is carried out by an external service provider, Vonage. FindTrucker.eu is not responsible for issues arising from the services of external providers.
• Data protection: Registering on the platform implies consent for data processing in accordance with the Privacy Policy.
• Users can manage their accounts, block unwanted messages, prevent contact from companies, and disable email notifications in the account settings.

3. Premium services and free trial period

• Companies: Companies can use paid premium services, which include the ability to post up to 5 job offers per month and initiate unlimited conversations with drivers. FindTrucker.eu reserves the right to modify the scope and pricing of premium services.
• Free trial period: During the first 30 days after registration, companies can post one job offer and initiate one conversation with a driver for free.
• Drivers: Drivers can access detailed profile statistics, send and verify references, and obtain certificates after completing courses available on the platform.

4. Certificates

• Certificates obtained on the platform are only proof of passing an internal exam. They do not have legal or official validity for performing a profession.

5. Payment terms

• Payment provider: Payments are processed by an external licensed payment provider, Stripe.
• Types of payments: Users can choose between one-time or recurring payments. Recurring payments are automatically renewed unless the user cancels the subscription before the start of the next cycle. Subscriptions can be canceled at any time through the user panel.
• No right of withdrawal: As the provision of services begins immediately after payment, the company has no right to withdraw from the contract in accordance with Article 38(1) of the Consumer Rights Act (regarding services initiated at the consumer’s request before the withdrawal period expires).
• No refunds: All payments are final and non-refundable, except in cases of technical errors that prevent the use of the platform’s services.

6. Content publication rules and liability

• Intellectual property rights: All content published on FindTrucker.eu must comply with the law and must not infringe on the intellectual property rights or copyrights of third parties.
• Liability for content: Companies are required to publish truthful information in accordance with the law. FindTrucker.eu reserves the right to remove or block content that violates terms, laws, or ethical standards.
• Content moderation: The platform’s administrators reserve the right to moderate or remove user content without prior notice in the event of violations of the terms.
• Protection of content and intellectual property rights: All content, graphics, databases, and other elements of the platform are protected by intellectual property rights, including sui generis rights to databases. Copying, modifying, distributing, or downloading content without the provider’s consent is prohibited and subject to civil and criminal liability.

7. Reporting irregularities and violations

• Users have the ability to report irregularities, such as false job offers, using a special form available on the platform. FindTrucker.eu will take appropriate measures to verify the reports and reserves the right to delete an account without compensation in case of serious violations.

8. Changes to the terms and conditions

• FindTrucker.eu reserves the right to make changes to the terms and conditions. Information about the changes will be posted on the website in the “News” section at least two weeks before the new terms come into effect. Users will be required to accept the changes, and failure to do so within the stipulated time (30 days) may result in account suspension.

9. Suspension of access

• FindTrucker.eu reserves the right to temporarily or permanently block a user’s account in the event of a violation of the terms and conditions, harmful actions towards the platform or other users, or illegal actions, such as sending spam or posting false content.

10. Personal data protection

• FindTrucker.eu is committed to protecting users’ personal data in accordance with the applicable legal regulations (GDPR). Data is stored on servers within the European Union. Users’ data will not be transferred to other companies or entities without their consent.
• Users can consent to receive marketing information.
• Profiling: Using the platform may involve profiling users to tailor job offers. By registering on the platform, users consent to such profiling.

11. Complaints and dispute resolution

• Complaints: Users can submit complaints about the functioning of the FindTrucker.eu platform via the contact form. Complaints will be resolved within 14 days.
• Dispute resolution: In the event of a dispute, FindTrucker.eu recommends resolving the dispute amicably through mediation. If mediation fails, disputes will be resolved in accordance with the laws of the country where FindTrucker.eu is based.
